Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ClinicalRN application and website (the “Service”), operated by Synesthesia LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Medical & Educational Disclaimer

ClinicalRN is an educational tool for nursing practice and exam preparation. It is not medical advice and is not a substitute for professional clinical judgment, formal training, institutional protocols, or the direction of a licensed supervisor or physician. Content is provided for learning only and must never be used to diagnose, treat, or make decisions about the care of any real patient. Always follow your organization’s policies and applicable standards of care. We make no warranty that the content is accurate, complete, current, or suitable for any particular purpose.

Eligibility & Accounts

You must be at least 13 years old to use the Service. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.

Subscriptions & Billing

The Service offers a free tier and a paid “Pro” subscription. Paid subscriptions are billed in advance through our payment processor and, unless cancelled, renew automatically at the end of each billing period. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current period. Where you purchase a subscription through a third-party app store, that store’s payment and refund rules also apply. Except where required by law, payments are non-refundable.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Copy, scrape, resell, or redistribute the questions, rationales, or other content without our permission.
  • Share your account, circumvent access or payment controls, or attempt to gain unauthorized access to the Service or other users’ data.
  • Interfere with, disrupt, or place undue load on the Service or its infrastructure.
  • Post content in social features that is unlawful, harassing, infringing, or otherwise objectionable.

User Content

Some features let you submit content, such as a display name or messages in study groups. You retain ownership of what you submit, but you grant us a limited license to host and display it as needed to operate the Service. You are responsible for the content you post, and we may remove content or restrict accounts that violate these Terms.

Intellectual Property

The Service, including its questions, rationales, software, design, and branding, is owned by Synesthesia LLC and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own educational purposes. No other rights are granted.

Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent permitted by law, Synesthesia LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.

Termination

You may stop using the Service and delete your account at any time from Settings → Account. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) will survive.

Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, United States, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or a small-claims exception.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
